Brim Terms of Use

These Terms of Use apply to Brim (“the App”).
If you obtain the App through the Apple App Store, Apple’s Standard End User License Agreement may also apply. If these Terms conflict with Apple’s Standard EULA or mandatory provisions of applicable law, Apple’s Standard EULA or the mandatory provisions of applicable law will control.
1. Acceptance of Terms
By downloading, installing, accessing, or using the App, you agree to these Terms of Use and the Brim Privacy Policy. If you do not agree, stop using the App and uninstall it.
2. App Features
Brim provides note creation, editing, display, search, tags, trash, images and attachments, iCloud sync, multi-device use, and related supporting features.
Some features may only be available on specific platforms, system versions, devices, iCloud states, or when the required purchase entitlement is active.
3. License to Use
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable license to install and use the App on Apple devices that you own or control.
You may not:
- Copy, modify, distribute, rent, sell, or sublicense the App.
- Reverse engineer, decompile, or attempt to extract source code from the App, except where applicable law expressly permits it.
- Bypass purchase, entitlement, feature, or security restrictions.
- Use the App for unlawful, infringing, abusive, harassing, fraudulent, destructive, or otherwise improper purposes.
- Interfere with the normal operation of the App, Apple services, iCloud, StoreKit, or other users.
4. Your Content
You retain rights to the content you create, enter, or import into the App.
You are responsible for ensuring that the content you create, save, import, or share does not infringe third-party rights, violate applicable law, or contain malicious code or unlawful material.
The App primarily stores content on your device and in your Apple iCloud account. We do not claim ownership over your notes, images, or attachment content.
5. iCloud and Sync
If you enable iCloud, the App uses Apple iCloud/CloudKit to sync content across your devices. iCloud services are provided by Apple and are subject to Apple’s own terms and privacy policies.
iCloud sync may be affected by network conditions, Apple service availability, system settings, account status, storage limits, region, and device constraints. Delays, conflicts, or failures may occur. The App will make reasonable efforts to preserve data consistency, but it does not guarantee that all sync operations will be immediate or error-free at all times.
You should back up important content as needed.
6. Camera, Photos, and System Permissions
On iOS, the App may request camera or photo permissions in order to take photos, add images, or save images. You can deny or revoke these permissions in system settings.
If you deny these permissions, the related features may be unavailable, but other core note features of the App should remain usable.
7. Purchases, Subscriptions, Entitlements, and Refunds
The App may offer auto-renewable subscriptions, one-time purchases, or other in-app purchase items. The available items, prices, billing periods, trials, promotional offers, and unlocked features are governed by the information shown in the App Store or in-app purchase screens.
Subscriptions renew automatically unless you cancel through your Apple ID, the App Store, or system settings before the end of the current subscription period. After cancellation, you can usually continue using subscribed features until the end of the current billing period. After that period ends, the subscription entitlement may expire and related paid features may be limited or unavailable.
One-time purchases are non-consumable purchases. After a successful purchase, the App unlocks the relevant functionality based on transaction state returned by Apple. Unless otherwise required by applicable law, Apple’s policies, or these Terms, a one-time purchase entitlement does not require recurring payment.
All purchases are processed by Apple App Store and StoreKit. Pricing, taxes, payment handling, renewals, cancellations, refunds, and family sharing are governed by the information shown by Apple and Apple’s own rules. You may manage subscriptions and restore purchases through the App Store, system settings, or the entry points provided by the App.
Unless otherwise required by applicable law or Apple’s policies, refund requests should be handled through Apple.
8. Free Features, Paid Features, and Changes
The App may provide a free Basic mode with usage limits. Current limits are shown in the App and may apply to notes, tag associations, images, attachments, or other resources. Items in trash or pending deletion may still count toward limits until permanently removed.
If a subscription expires, a purchase is refunded or revoked, or entitlement verification changes, paid features such as iCloud sync may be disabled or limited until a valid entitlement is restored.
We may add, modify, suspend, or remove features, and we may adjust the scope of free features, subscription features, and one-time purchase features. For non-consumable items already purchased, we will make reasonable efforts to continue honoring the corresponding entitlement. If the App changes from a one-time purchase model to a subscription model, we will not withdraw the primary functionality you already paid for solely because of that business model change. The experience may still be affected by platform, system, device, Apple service, legal, or ongoing maintenance constraints.
If terms such as “lifetime” are used for non-consumable purchases, they mean access to the relevant functionality for as long as the App and related platform support remain available. They do not mean that any specific feature, service, or platform will remain unchanged or available forever.
9. Feedback
If you provide suggestions, feedback, bug reports, screenshots, logs, or improvement ideas by email, TestFlight forms, or other means, you agree that we may use that feedback without payment to investigate issues, improve features, and optimize the App. You retain any rights you may have in the original content of your feedback.
Please do not send unrelated sensitive information, other people’s personal information, passwords, payment information, or note content that you do not want us to see.
10. Third-Party Services
The App relies on Apple-provided platform capabilities and services, including but not limited to the App Store, StoreKit, iCloud, CloudKit, TestFlight, system diagnostics, camera permissions, and photo permissions.
These services are provided by Apple and are subject to Apple’s terms, privacy policies, and service availability. We do not control Apple services and are not responsible for interruptions, changes, or policies imposed by Apple.
11. Disclaimer
To the maximum extent permitted by applicable law, the App is provided on an “as is” and “as available” basis. We do not guarantee that the App will be error-free, uninterrupted, fully secure, fit for a particular purpose, or capable of meeting all of your expectations.
You understand that note data, attachments, sync behavior, and purchase entitlements may be affected by devices, systems, networks, iCloud, Apple services, or user actions. You should back up important data yourself.
12. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, punitive, or consequential damages, including loss of profits, loss of data, business interruption, or the cost of substitute services arising from your use of or inability to use the App.
If applicable law does not allow full exclusion of liability, our liability will be limited to the maximum extent permitted by law.
13. Termination
If you violate these Terms, we may suspend or terminate your right to use the App or related features to the extent permitted by law.
You may stop using and uninstall the App at any time. Uninstalling the App may not automatically delete data already synced to iCloud or purchase records retained by Apple.
14. Changes to the Terms
We may update these Terms as features, laws, platform rules, or business conditions change. Material changes may be communicated through the App, a website, or the App Store listing, as appropriate. Continued use of the App means you accept the updated Terms.
15. Governing Law and Disputes
These Terms are governed by the laws of Mainland China, without excluding any mandatory consumer protection laws that may apply in your region.
